Today we continue talking about HIV, this time from a legal perspective. Did you know that there are groups that are trying to have the crime called danger of contagion removed from the Federal Criminal Code? Article 199 Bis of said Code establishes what this crime consists of: “Whoever, knowing that he/she is ill with a venereal disease or other serious disease during the infectious period, endangers the health of another by sexual intercourse or any other transmissible means, shall be punished with three days to three years in prison and up to forty days of fine”.
If the danger of contagion is eliminated as a crime, a person could be infected with HIV by another person who hides the fact that he/she is a carrier and wants to have sexual relations. The infecting person could conceal from his or her sexual partner that he or she is a carrier of the virus in question.
So, for practical purposes, what we want to do today by eliminating the crime of danger of contagion, is to remove all responsibility from people who are carriers of HIV or other diseases, in case their sexual partners become infected because of them. Those who want to infect and hide need an excuse. What do they use as an argument? They say that “their human rights are violated” by having to report their status. We ask ourselves, what about the rights of people who are healthy and put themselves at risk of infection by having a relationship with those who have HIV? Wouldn't they have the right to be informed beforehand that their potential partner has the virus and they run the risk of getting sick?
This is a very serious issue and one that is rarely discussed. In Nayarit and Mexico City the crime of danger of contagion has already been repealed from the Penal Codes of those states. It would not be strange if other states follow this trend, with which, we would have a potential health problem regarding not only HIV infection but also other sexually transmitted diseases. This is why it is necessary for people to be informed and to create awareness of the importance of living a responsible sexuality.

Hoy seguimos hablando del tema del VIH, esta vez desde la perspectiva jurídica. ¿Sabías que hay grupos intentan que el delito denominado peligro de contagio se quite del Código Penal Federal? Dicho ordenamiento, en su artículo 199 Bis, establece en qué consiste ese delito: “El que a sabiendas de que está enfermo de un mal venéreo u otra enfermedad grave en período infectante, ponga en peligro de contagio la salud de otro, por relaciones sexuales u otro medio transmisible, será sancionado de tres días a tres años de prisión y hasta cuarenta días de multa”.
Si se elimina el peligro de contagio como delito una persona podría ser contagiada de VIH por otra que le oculta que es portador y que quiera tener relaciones sexuales. El que contagia podría ocultarle a su pareja sexual que es portadora del virus en cuestión.
Entonces, para fines prácticos, lo que hoy se quiere hacer al eliminar el delito de peligro de contagio, es deslindar de toda responsabilidad a las personas que son portadoras de VIH u otras enfermedades, en caso de que por su causa sus parejas sexuales se contagien. Los que quieren contagiar y ocultar necesitan una excusa. ¿Qué usan como argumento? Dicen de que “se violentan sus derechos humanos” al tener que informar su condición. Nosotros nos preguntamos, ¿y qué hay de los derechos de las personas que están sanas y se ponen en riesgo de contagio al relacionarse con los que tienen VIH? ¿No tendrían derecho de tener previamente la información de que su potencial pareja posee ese virus y corren el riesgo de enfermarse?
Este es un tema muy serio y del que se habla muy poco. En Nayarit y en la Ciudad de México el delito de peligro de contagio ya se derogó de los Códigos Penales de esas entidades. No sería extraño que otros estados sigan esta tendencia, con lo cual, tendríamos un potencial problema de salud con respecto no solo al contagio del VIH sino también de otras enfermedades de transmisión sexual. Por ello es necesario que las personas estén informadas y crear conciencia de la importancia de vivir una sexualidad responsable.
