The Archdiocese of Maceió [Brazil] has released an official note in which it affirms that the celebration of the Mass according to the missal of St. Pius V outside the only authorized place [a very small chapel] will be considered an "act of public schism" and that this will imply automatic excommunication for the faithful attending by virtue of canons 751 and 1364 §1 of the Code of Canon Law.
The text, authorized by Bishop Carlos Alberto Breis Pereira O.F.M, also indicates that Mass in the ancient rite is only allowed in the Chapel of São Vicente de Paulo once a week and that it is not authorized "in any other place," whether religious or not, nor in civil law associations.
The question is not only to discipline. It is one thing to restrict a place of celebration and another, radically different, to qualify as schismatics those who participate in eventual unauthorized celebrations and to associate that participation with the most severe penalty of the canonical order. To speak of schism and automatic excommunication is not a rhetorical formula: it is to place specific people in the highest penal field, with devastating spiritual and juridical effects.
It is worth clarifying the concepts. Canon 751 defines schism as the refusal to submit to the Roman Pontiff or the refusal to communion with the members of the Church subject to him. That is, schism is not "doing something without permission," or "preferring a rite," or even "disobeying" at a particular point. It is a formal and effective break of communion with the authority of the Pope or with ecclesial communion. It is an exceptional category, because it describes a fracture of the visible bond of the Church.

Canon 1364 §1 establishes that the apostate, the heretic or the schismatic incur latae sententiae, that is, automatic excommunication, for the very fact of committing the crime. But for there to be a "crime" it is not enough for an ecclesiastical superior to affirm it in a note. In canon criminal law, classical principles apply: strict typicity, restrictive interpretation of penalties, imputability of the subject and, ordinarily, conduct objectively suitable to cause the rupture of communion that the norm describes.
For this reason, identifying the celebration of the ancient rite outside an authorized place as a schism poses a fundamental problem. Disciplinary illegality, even serious ones, does not automatically become schism, much less about the faithful. In order to speak of schism, it must be possible to prove that the act implies, by its nature or by the intention of those who perform it, a refusal to submit to the Pope or a rupture of communion. Without this intention of separation, the criminal label becomes expansive and arbitrary. And when an automatic penalty is extended by interpretative means beyond the criminal type, what appears is legal uncertainty.
This has immediate pastoral consequences. Episcopal authority, by its very purpose, is ordered to the edification and salvation of souls. The use of the maximum penal language in a liturgical conflict produces the opposite: uneasiness, confusion, fear in conscience and public scandal. If it is transmitted to the faithful that they may be "automatically" excommunicated for attending a celebration in the ancient rite outside a specific place, a spiritual pressure is introduced that is inappropriate to the law, which should protect people against disproportionate applications of punitive power.
Didactically, the decisive distinction is this. A celebration can be illicit without being schismatic. An act can be disobedient without amounting to a break of communion with the Roman Pontiff. And a penalty as extreme as excommunication cannot become an ordinary disciplinary control mechanism, nor can it be applied by conceptual extension. Excommunication is designed for cases in which communion is broken in a real and formal way, not to settle controversies by means of a criminal shortcut.
If there is also talk of excommunication latae sententiae, the rigor must be greater. Automatic excommunication does not depend on an administrative declaration; it depends on the objective existence of the crime in the strict terms of the law. Precisely for this reason, the juridical tradition of the Church has insisted on interpreting these penalties restrictively and on preventing the faithful from being at the mercy of maximalist readings of the criminal type.
When automatic excommunication is invoked in a disputed matter, the risk of injustice and abuse of conscience is multiplied.
The Holy See, guarantor of unity and the correct use of universal law, should urgently clarify the scope of this type of official communication. If the idea that celebrating or attending the ancient rite outside an authorized place is "in itself" a schismatic act is consolidated, the degradation of canonical juridical security reaches very serious levels. It is not a liturgical dispute: it is the very threshold between discipline and ecclesial rupture, between pastoral correction and extreme penal sanction.
Either Rome corrects and precisely delimits this classification, or a dangerous pattern is normalized: the use of episcopal authority to produce unrest and scandal in souls through maximum penal threats without the strict configuration of the crime. In the Church, authority is there to safeguard communion, not to empty the notion of schism of juridical content or to trivialize excommunication. When the law is used as a weapon and not as a guarantee, the wound is not suffered only by a group of the faithful: it is suffered by the credibility of ecclesial justice and trust in pastoral government itself.

La Arquidiócesis de Maceió ha difundido una nota oficial en la que afirma que la celebración de la Misa según el misal de San Pío V fuera del único lugar autorizado será considerada “acto de cisma público” y que ello implicará a los fieles asistentes la excomunión automática en virtud de los cánones 751 y 1364 §1 del Código de Derecho Canónico. El texto, autorizado por el obispo Carlos Alberto Breis Pereira O.F.M, indica además que la Misa en el rito antiguo solo está permitida en la Capilla de São Vicente de Paulo una vez por semana y que no está autorizada “en ningún otro lugar”, sea religioso o no, ni en asociaciones de derecho civil.
La cuestión no es solo disciplinar. Una cosa es restringir un lugar de celebración y otra, radicalmente distinta, calificar de cismáticos a quienes participan en eventuales celebraciones no autorizadas y asociar esa participación a la pena más severa del ordenamiento canónico. Hablar de cisma y de excomunión automática no es una fórmula retórica: es situar a personas concretas en el terreno penal máximo, con efectos espirituales y jurídicos devastadores.
Conviene aclarar los conceptos. El canon 751 define el cisma como la negativa de sujeción al Romano Pontífice o la negativa de comunión con los miembros de la Iglesia sometidos a él. Es decir, el cisma no es “hacer algo sin permiso”, ni “preferir un rito”, ni siquiera “desobedecer” en un punto concreto. Es una ruptura de comunión, formal y efectiva, con la autoridad del Papa o con la comunión eclesial. Es una categoría excepcional, porque describe una fractura del vínculo visible de la Iglesia.

El canon 1364 §1 establece que el apóstata, el hereje o el cismático incurren en excomunión latae sententiae, esto es, automática, por el propio hecho de cometer el delito. Pero para que exista “delito” no basta con que un superior eclesiástico lo afirme en una nota. En derecho penal canónico rigen principios clásicos: tipicidad estricta, interpretación restrictiva de las penas, imputabilidad del sujeto y, de ordinario, una conducta objetivamente idónea para causar la ruptura de comunión que la norma describe.
Por eso, identificar como cisma la celebración del rito antiguo fuera de un lugar autorizado plantea un problema de fondo. La ilicitud disciplinar, incluso grave, no se convierte automáticamente en cisma y mucho menos sobre los fieles. Para hablar de cisma debe poder acreditarse que el acto implica, por su naturaleza o por la intención de quienes lo realizan, una negativa de sujeción al Papa o una ruptura de comunión. Sin esa intención de separación, la etiqueta penal se vuelve expansiva y arbitraria. Y cuando una pena automática se extiende por vía interpretativa más allá del tipo penal, lo que aparece es inseguridad jurídica.
Esto tiene consecuencias pastorales inmediatas. La autoridad episcopal, por su propia finalidad, está ordenada a la edificación y a la salvación de las almas. El uso del lenguaje penal máximo en un conflicto litúrgico produce lo contrario: inquietud, confusión, temor en conciencia y escándalo público. Si se transmite a los fieles que pueden quedar excomulgados “automáticamente” por asistir a una celebración en el rito antiguo fuera de un lugar concreto, se introduce una presión espiritual impropia del derecho, que debe proteger a las personas contra aplicaciones desproporcionadas del poder punitivo.
Didácticamente, la distinción decisiva es esta. Una celebración puede ser ilícita sin ser cismática. Un acto puede ser desobediente sin equivaler a una ruptura de comunión con el Romano Pontífice. Y una pena tan extrema como la excomunión no puede convertirse en un mecanismo de control disciplinar ordinario, ni aplicarse por extensión conceptual. La excomunión está pensada para supuestos en los que la comunión se rompe de manera real y formal, no para zanjar controversias mediante un atajo penal.
Si además se habla de excomunión latae sententiae, el rigor debe ser mayor. La excomunión automática no depende de una declaración administrativa; depende de la existencia objetiva del delito en los términos estrictos de la ley. Precisamente por eso, la tradición jurídica de la Iglesia ha insistido en interpretar restrictivamente estas penas y en evitar que el fiel quede a merced de lecturas maximalistas del tipo penal. Cuando se invoca la excomunión automática en una materia discutida, el riesgo de injusticia y de abuso en la conciencia se multiplica.
La Santa Sede, garante de la unidad y del recto uso del derecho universal, debería clarificar urgentemente el alcance de este tipo de comunicaciones oficiales. Si se consolida la idea de que celebrar o asistir al rito antiguo fuera de un lugar autorizado es “por sí mismo” un acto cismático, la degradación de la seguridad jurídica canónica alcanza niveles gravísimos. No es una disputa litúrgica: es el umbral mismo entre disciplina y ruptura eclesial, entre corrección pastoral y sanción penal extrema.
O Roma corrige y delimita con precisión esta calificación, o se normaliza un patrón peligroso: el empleo de la autoridad episcopal para producir desasosiego y escándalo en las almas mediante amenazas penales máximas sin la estricta configuración del delito. En la Iglesia la autoridad está para custodiar la comunión, no para vaciar de contenido jurídico la noción de cisma ni para trivializar la excomunión. Cuando el derecho se usa como arma y no como garantía, la herida no la sufre solo un grupo de fieles: la sufre la credibilidad de la justicia eclesial y la confianza misma en el gobierno pastoral.^^
